Habeas Corpus and Prolonged ICE Detention

When detention stretches past months without a bond hearing, federal district court may be the fastest path to release.

Immigration detention is civil, not punitive — yet detainees routinely spend six months or longer in custody while their removal cases proceed. Where detention becomes unreasonably prolonged, a habeas petition under 28 U.S.C. § 2241 asks a federal judge to order a bond hearing or release.

The petition must be filed in the district of confinement and name the proper custodian. Timing, venue, and the factual record on the length and cause of delay drive the outcome.
